ARTICLE 1. PARTIES
These General Terms and Conditions of Sale (GTC) are concluded between:

1.1 Acceptance of the General Terms and Conditions

1.2 Legal Capacity
The Client certifies having the full legal capacity to commit under these GTC. If the order is placed on behalf of a legal entity, the Client guarantees having the necessary powers to act on behalf of that entity.
1.3 Modification of the GTC
The Seller reserves the right to modify these GTC at any time. The applicable conditions are those in force on the date the order is validated. Any use of the site after a modification implies acceptance of the new GTC.
ARTICLE 2. DEFINITIONS

2.4 Order
The operation by which the Client selects one or more Products offered for sale on the Site, adds them to their basket, provides the necessary billing and delivery information, and then validates the purchase via secure payment.
2.5 Contract
The distance selling contract concluded between the Seller and the Client following the validation of the Order by the Client and the confirmation by the Seller, in accordance with these GTC.
2.6 Parties
The Seller, defined in Article 1 of these GTC, and the Client, as defined above, contracting within the framework of an online sale via the Site.
2.7 Internet User
Any person, individual or legal entity, under private or public law, accessing the Site for consultation or browsing purposes, whether or not they place an order.
2.8 Site Content
All elements published on the Site, whether or not protected by intellectual property rights, including texts, images, designs, logos, videos, diagrams, databases, or software.
2.9 Delivery
The physical transfer of the Products ordered by the Client to the address indicated by the latter during the Order. The terms, deadlines, and delivery costs are defined in the specific articles of these GTC.

These GTC exclusively govern the contractual relations between SAS Provence Millésime and the Client within the framework of the purchase of Products via the website www.chateausaintpierre.com. They define the rights and obligations of the Parties in the context of online sales.
They apply to all Orders placed by the Client on the Site and to all deliveries carried out by SAS Provence Millésime, regardless of the specific nature of the Products.
3.2 Acceptance of the GTC
By validating an Order on the Site, the Client fully and unreservedly accepts these GTC. This acceptance is materialized by a checkbox preceding the finalization of the Order.

3.4 Client's Legal Capacity
The Client declares having the legal capacity to contract under the conditions provided for in these GTC, in accordance with the provisions of Articles 1145 et seq. of the Civil Code.
The Client undertakes that all information they provide during the Order is accurate and sincere. Any identity theft or communication of false information is the exclusive responsibility of the Client.
3.5 Exclusions
These GTC do not apply to purchases made directly from the SAS Provence Millésime estate, in the shop, or at external events such as trade shows or fairs. They only concern sales made via the Internet Site.
ARTICLE 4. PURPOSE OF THE SITE
4.1 Presentation of Products

- Replacement with an equivalent Product (if available),
- Refund of the unavailable Product.
4.3 Access and Navigation
The Site is accessible to any Internet User with internet access. Use of the Site implies acceptance of these GTC as well as any complementary general terms of use (GTU).
SAS Provence Millésime implements all necessary means to guarantee the accessibility of the Site, but cannot be held responsible in the event of a technical malfunction preventing temporary or prolonged access to the Site.
4.4 Legal Restrictions
Access to the Site and the purchase of Products containing alcohol are prohibited to minors. The Client declares to be of legal age in accordance with the legislation in force in their country of residence.
The Site is intended for sales in France and in territories where regulations authorize the online sale of alcoholic beverages. It is the Client's responsibility to verify the conformity of the Products with the laws applicable in their country before ordering.
4.5 Responsible Consumption
SAS Provence Millésime encourages responsible consumption of its Products and reminds that alcohol abuse is dangerous for health.

ARTICLE 5. ORDER STEPS
5.1 Product Selection
The Client can browse the Site and select the Products of their choice by clicking on the "Add to Cart" button available on each product page. At any time, the Client can consult the contents of their cart, modify quantities, or remove a Product before validating the Order.
5.2 Account Creation or Connection
To finalize their Order, the Client must:
- Log in to their personal account if they already have one, or
- Create an account by completing the registration form with their personal information (last name, first name, delivery address, email address, phone number).
The Client undertakes to provide accurate and up-to-date information. Any omission or error in the information provided is the responsibility of the Client.
5.3 Cart Validation
Before finalizing their Order, the Client is invited to check the summary of the Products added to their cart, including:
- The description of the Products,
- The unit price and the total price including tax (TTC),
- Any delivery costs.
The Client can still modify or correct the elements before proceeding to payment.
5.4 Order Payment

5.6 Order Tracking

5.7 Order Cancellation or Modification
Once confirmed, the Order can only be canceled or modified with the express agreement of SAS Provence Millésime. In the event of an accepted cancellation, any refund will be made in accordance with legal provisions and these GTC.
5.8 Order Archiving
Order information is archived by SAS Provence Millésime in accordance with Article L. 213-1 of the Consumer Code. The Client can access it upon request or from their personal space on the Site.
ARTICLE 6. PRICE AND PAYMENT TERMS
6.1 Price of Products
The prices of the Products displayed on the site www.chateausaintpierre.com are expressed in euros (€), inclusive of all taxes (TTC), excluding delivery costs.
- Delivery costs, when applicable, are indicated to the Client before the Order is validated.
- SAS Provence Millésime reserves the right to modify its prices at any time. However, Products will be billed at the rate in effect at the time the Order is validated by the Client.
- In the case of an Order destined for a country outside the European Union, the Client is responsible for any customs duties, local taxes, or additional import charges.
6.2 Invoicing
A detailed invoice is sent by email to the Client after Order validation. This invoice includes the details of the ordered Products, their unit price, the total TTC amount, and, where applicable, the delivery costs.
6.3 Payment Terms
The Client can pay for their Orders using one of the following payment methods offered on the Site:
Bank card
Accepted cards include Visa, MasterCard, and other compatible cards. Payment by bank card is made via a secure platform that guarantees the confidentiality and protection of transmitted data.
Bank transfer
The Client can choose to pay by bank transfer. The information necessary for the transfer (bank details of SAS Provence Millésime) is provided during Order validation. Order processing will only begin after the full amount due has been received in the Seller's bank account.
Cheque
Payments by cheque are accepted for orders placed in metropolitan France. The cheque must be made payable to SAS Provence Millésime and sent to the following address:

The Order will only be processed after the cheque has been effectively cashed.
For payments by bank transfer and cheque, the Client has a period of 7 working days to complete the payment. After this period, the Order will be automatically canceled.
6.4 Payment Security
Payments made on the Site are secured by an encryption protocol guaranteeing the confidentiality of transmitted data. SAS Provence Millésime does not have access to the Client's bank information in any case, as this is directly processed by the secure payment platform.
6.5 Default in Payment
In the event of non-payment, or rejection of payment by the Client's bank, the Order will be automatically canceled. SAS Provence Millésime also reserves the right to refuse any new Order from a Client in the event of a previous payment incident.
6.6 Late Payment (for professional Clients)
In accordance with Articles L. 441-10 et seq. of the Commercial Code, any late payment will result in:
- The application of penalties calculated at the legal rate in force, without prior formal notice being necessary.
- A fixed compensation for recovery costs amounting to €40.
6.7 Retention of Title
The Products remain the property of SAS Provence Millésime until their full payment by the Client. However, from the moment of their receipt by the Client, the risks of loss or deterioration are transferred to them.
ARTICLE 7. RIGHT OF WITHDRAWAL AND WARRANTIES
7.1 Right of Withdrawal
In accordance with Articles L. 221-18 et seq. of the Consumer Code, the Client has a period of fourteen (14) days from the receipt of the Products to exercise their right of withdrawal, without having to provide reasons or pay penalties, with the exception of return costs.
To exercise this right, the Client must notify their decision to withdraw to SAS Provence Millésime by an unambiguous statement (for example, postal mail or email). For this purpose, the Client may use the standard withdrawal form below, although this is not mandatory.

The direct return costs are the exclusive responsibility of the Client, except in the case of an error attributable to the Seller.
In the event of a valid withdrawal, the refund will be made within fourteen (14) days from the receipt of the Products or proof of their shipment.
7.2 Return Procedures
The Client must return the Products within a maximum period of fourteen (14) days following the notification of their decision to withdraw, to the following address:

The Products must be returned in their original condition, unopened, and in their original packaging. Return costs are the exclusive responsibility of the Client, unless the return results from an error attributable to the Seller.
7.3 Refund
In the event of exercising the right of withdrawal, SAS Provence Millésime will refund the sums paid by the Client, including standard delivery costs, within a maximum period of fourteen (14) days following the receipt of the returned Products or proof of their shipment.
The refund will be made using the same means of payment as that used for the initial transaction, unless the Client expressly agrees to another means.
7.4 Legal Warranties
The Products sold on the Site benefit from:
The legal guarantee of conformity (Articles L. 217-4 et seq. of the Consumer Code), allowing the Client to request the repair, replacement, or refund of the Product in case of lack of conformity.
The legal warranty against hidden defects (Articles 1641 et seq. of the Civil Code), allowing the Client to request the cancellation of the sale or a reduction in the price if a hidden defect renders the Product unfit for its intended use.
7.5 Procedure for Implementing Warranties

The return of defective or non-conforming Products will be at the expense of SAS Provence Millésime, after validation by customer service.
7.6 Limitation of Liability
The liability of SAS Provence Millésime is limited to the amount paid by the Client for the defective or non-conforming Product. No additional warranty can be required, particularly in the event of improper storage of the Products by the Client after their delivery.
ARTICLE 8. PERSONAL ACCOUNT
8.1 Creation of the Personal Account
To place an Order on the Site, the Client must create a personal account by providing the following information:

- Full postal address,
- Valid email address,
- Phone number,
- Secure password.
The Client undertakes to provide accurate and up-to-date information. Any omission or false declaration may lead to the suspension or deletion of the personal account by SAS Provence Millésime.
8.2 Access to the Personal Account

- Track the status of their Orders,

SAS Provence Millésime undertakes to securely retain the contractual data required by law for a defined period (in accordance with Articles L. 213-1 and D. 213-2 of the Consumer Code).
8.4 Deletion of the Personal Account
The Client may at any time request the deletion of their personal account by contacting customer service at the email address: contact@chateausaintpierre.com.
SAS Provence Millésime reserves the right to delete a personal account in the following cases:
- Non-compliance with these GTC by the Client,
- Account inactive for more than two (2) years,
- Provision of inaccurate or fraudulent information.
The deletion of the personal account does not entail the erasure of contractual data necessary to comply with legal obligations (e.g., retention of invoices).
8.5 Data Security
SAS Provence Millésime implements all technical and organizational measures to ensure the security of the Client's personal data in accordance with the GDPR. In the event of a security breach, the Client will be informed as quickly as possible, in accordance with applicable regulations.
ARTICLE 9. DELIVERY
9.1 Delivery Zones
SAS Provence Millésime offers delivery of its Products to the following countries:
- France (including Corsica and Monaco),

9.3 Delivery Times
Delivery times are indicative and vary depending on the country of destination and the chosen mode of transport:

The Client is required to check the condition of the Products upon receipt. If the package is damaged or if Products are missing or incorrect, the Client must:
Write precise reservations on the delivery slip or the carrier's scanner,
Notify the customer service of SAS Provence Millésime within three (3) working days of receipt, providing:
- A detailed description of the anomaly,
- Photographic evidence of the package and damaged Products.

9.6 Delivery Delay or Impossibility

9.8 Delivery to Countries Outside the European Union
For orders destined for countries outside the European Union, including Canada and Switzerland, the Client is informed that:

ARTICLE 11. ONLINE SALE OF WINES: SPECIFIC REGULATIONS
11.1 Legal Capacity

In case of doubt or absence of supporting documentation, delivery will be refused and the package returned to the Seller. The return and re-shipment costs will then be the exclusive responsibility of the Client.
11.5 Responsibility for Storage
Once delivered, the Products become the exclusive responsibility of the Client. SAS Provence Millésime declines all responsibility in case of deterioration of the Products related to inadequate storage (e.g., exposure to heat, humidity, or direct light).
11.6 Warranties on Alcoholic Beverages
The wines and other alcoholic beverages offered by SAS Provence Millésime are subject to the legal warranties of conformity and against hidden defects, as defined in ARTICLE 7 of these GTC.
Due to the nature of the Products, organoleptic variations due to aging or storage conditions cannot be considered defects or hidden flaws.
11.7 Resolution of Disputes Related to the Sale of Alcohol
Any dispute relating to the online sale of alcoholic beverages is subject to French law. In the event of a dispute, the Parties undertake to seek an amicable solution before considering legal action or recourse to mediation.
11.8 Compliance with Local Regulations
The Client is responsible for checking the local regulations applicable in the country of destination before placing an Order, particularly for alcoholic beverages.
Prohibited or Regulated Products :
- Certain countries impose restrictions on the import of alcoholic beverages (maximum quantity, complete prohibition, specific licenses).
- SAS Provence Millésime cannot be held responsible in case of confiscation or refusal of entry of the Products by local authorities.
Client's Responsibility :
- By placing an Order, the Client acknowledges being fully informed of customs requirements and guarantees their compliance.
- Any fine, tax, or fee resulting from non-compliance with local laws is the exclusive responsibility of the Client.
11.9 Take-Away Sales License
SAS Provence Millésime holds take-away sales license no. [number to be completed], issued by [competent authority, generally the prefecture or the town hall]. This license permits the remote sale of alcoholic beverages, in accordance with the regulations in force.
ARTICLE 12. LIMITATION OF LIABILITY
12.1 General Liability
SAS Provence Millésime cannot be held responsible for indirect, immaterial, or consequential damages that may result from the use of the website or the purchase of the Products, notably a loss of profits, revenue, data, or opportunities.
12.2 Force Majeure
The liability of SAS Provence Millésime cannot be engaged in case of force majeure, as defined by Article 1218 of the Civil Code, including, but not limited to:
- Bad weather, natural disasters, fires, floods,
- Strikes, social conflicts, civil unrest, terrorist acts,
- Technical failures affecting telecommunication or transport networks.
12.3 Client's Responsibility
The Client is solely responsible for:
- Storage of Products : Any deterioration related to inadequate storage (exposure to light, humidity, excessive heat, etc.) after delivery is their doing.
- Providing accurate information : In case of error or omission in the contact details provided, SAS Provence Millésime cannot be held responsible for delays or delivery failures.
- Compliance with local laws : The Client must ensure that the purchase and import of the Products comply with the laws and regulations of their country.
12.4 Specific Exclusions
SAS Provence Millésime cannot be held responsible for natural variations in the organoleptic characteristics of the wines (taste, aromas, textures) related to aging or storage conditions.
12.5 Use of Products
The Client is required to use the Products responsibly and in compliance with health warnings. SAS Provence Millésime declines all responsibility in case of alcohol abuse or consequences related to excessive consumption.
ARTICLE 13. MEDIATION AND DISPUTE RESOLUTION
In accordance with Articles L. 611-1 et seq. of the Consumer Code, the consumer Client has the right to use a consumer mediator free of charge for the amicable resolution of a dispute with SAS Provence Millésime.
